Terms of Service

These Terms of Service ("Terms") govern your access to and use of Zendbee, a lead enrichment and outreach personalization service operated by Floclick ("we", "us", "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Zendbee allows users to upload lists of companies and receive enriched data including AI-generated summaries, company intelligence, and personalization variables for outreach purposes. The service is currently in closed beta and access is by invitation only.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use Zendbee. By accepting these Terms you represent that you meet these requirements. The service is intended for business use only and not for personal, household, or consumer purposes.

3. Account Registration

Access to Zendbee requires an invited account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at info@floclick.com if you become aware of any unauthorised access to your account.

You may not share your account credentials with third parties or allow others to access the service through your account.

4. Acceptable Use

You agree to use Zendbee only for lawful purposes and in accordance with these Terms. You must not:

• Use the service to send unsolicited bulk email or spam in violation of applicable law, including the CAN-SPAM Act and EU anti-spam regulations.
• Upload data you do not have the legal right to process.
• Use the service to harass, target, or discriminate against individuals.
• Attempt to reverse engineer, copy, or replicate any part of the service.
• Use automated scripts, bots, or crawlers to access the service.
• Interfere with the integrity or performance of the service or its underlying infrastructure.
• Use enriched data in any way that violates applicable data protection laws, including GDPR.

5. Your Data and Responsibilities

You retain ownership of all data you upload to Zendbee. By uploading data you grant us a limited licence to process it solely for the purpose of returning enriched results to you.

You are solely responsible for ensuring that your use of enriched data complies with all applicable laws, including data protection and privacy laws. If your uploaded data contains personal data about individuals, you are the data controller for that data and must have a lawful basis for processing it.

We act as a data processor on your behalf for any personal data contained in your uploads. See our Privacy Policy for further details.

6. Enrichment Data

Enriched results are generated from publicly available sources including company websites, LinkedIn company pages, news articles, and job postings, processed using AI. We do not guarantee the accuracy, completeness, or timeliness of enriched data. You are responsible for verifying any data before acting on it.

Enriched results are provided for informational and outreach purposes only. We make no warranties about their fitness for any particular purpose.

7. Intellectual Property

All rights in the Zendbee platform, including its software, design, and underlying technology, are owned by Floclick. Nothing in these Terms transfers any intellectual property rights to you.

You retain all rights in your uploaded data. We do not claim ownership of your data or your enriched results.

8. Billing and Payment

Subscription fees are charged in advance on a monthly or annual basis depending on your chosen plan. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

If a payment fails, we may suspend your account until payment is received. You are responsible for keeping your payment information up to date.

9. Termination

You may cancel your account at any time by contacting us at info@floclick.com. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account at any time if you violate these Terms, if we are required to do so by law, or if we reasonably believe your use of the service poses a risk to us or other users. We will give you reasonable notice where possible.

Upon termination, your right to access the service ceases immediately. We may delete your data in accordance with our retention policy.

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

We are not responsible for how you use enriched data. We do not guarantee that use of the service will result in any particular business outcome, reply rate, or sales result.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Floclick shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to loss of revenue, loss of data, or loss of business opportunity.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Floclick, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms are governed by the laws of Sweden. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden. If you are a consumer in the EU, you may also have recourse to dispute resolution mechanisms available under EU law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the service. Continued use of the service after changes take effect constitutes your acceptance of the updated Terms.
